Terms of Service
These Terms of Service ("Terms") govern your access to and use of PuckYard (the "Service"), a marketplace where private individuals and hockey clubs sell ice-hockey gear they no longer need directly to each other, in each of the markets the Service serves, operated by Explicants ("we", "us", "our"). By creating an account, posting a listing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About PuckYard
PuckYard is a platform where private individuals and hockey clubs post listings of ice-hockey equipment they no longer need, used or still unused, and contact each other to arrange in-person pickup. Sellers must be private individuals or hockey clubs: shops and other businesses may not sell on the Service, and nobody may sell as part of a trade. A club may list gear it owns and no longer needs; a club shop that buys gear to sell on is a business. We are not a party to any sale. We do not process payments, do not hold inventory, do not ship items, and do not act as broker, agent, insurer, or escrow service. Buyers and sellers transact directly with each other and arrange payment and pickup themselves, in person.
Using PuckYard is free of charge for buyers and sellers alike: there are no listing fees and no commission.
2. Eligibility
You must be at least 18 years old, or be using the Service under the supervision and with the consent of a parent or legal guardian, to use PuckYard. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into binding agreements.
3. Your account
You sign in using your email address and a one-time code (OTP) we send to that address. You are responsible for keeping your sign-in email secure and for all activity that takes place under your account. Each account is personal — you may not transfer, share, or sell access to your account.
You may close your account at any time from the Account page (Privacy & data → Delete my account). Deletion removes your profile and listings; messages you sent are retained for the other party's context but your name is shown as "Deleted user".
4. Listings and content
When you post a listing you confirm that:
- You own the item or have the legal right to sell it.
- The information and photos you provide are accurate and not misleading.
- The item is legal to sell in the country you list it in, and does not infringe any third-party rights.
- You will honour the price and condition you advertise when you meet a buyer in person.
- You are selling as a private individual or on behalf of a hockey club, not as or for a business. Unused items are welcome when they are your own, for example a gift in the wrong size.
We reserve the right to remove or edit any listing that we believe, in our reasonable judgment, violates these Terms, our community standards, or applicable law — with or without notice.
5. Buyer and seller transactions
All transactions take place directly between the buyer and the seller. We do not process payments and do not provide refunds. We do not arrange or insure shipping; listings are pickup-only and the parties agree the time, place, and method of payment themselves.
We strongly recommend meeting in a public place during daylight hours and inspecting the item before handing over payment. We are not responsible for the condition of items, the conduct of either party, the safety of the meeting, or any disputes that arise from a transaction.
6. Acceptable use
You agree not to use the Service to:
- List counterfeit, stolen, illegal, recalled, or hazardous items.
- Sell on behalf of a shop or other business, or sell as part of a trade.
- List items unrelated to ice hockey or otherwise inconsistent with the shop's purpose.
- Post content that is unlawful, defamatory, harassing, hateful, or sexually explicit.
- Spam, scrape, harvest emails, or otherwise use automated means to access the Service.
- Contact other users for any purpose other than discussing a listing on PuckYard.
- Attempt to circumvent the Service to arrange off-platform payments before meeting in person, fraud, or money laundering.
- Interfere with, probe, or compromise the security or integrity of the Service or its systems.
- Impersonate another person or misrepresent your affiliation with any person or entity.
7. Reporting and moderation
If you see a listing, message, or user that violates these Terms, use the Report function on the listing page, the seller's profile, or the conversation. Reports are reviewed by a moderator and may result in the content being hidden or the account being banned. We respect the reporter's confidentiality.
If a conversation turns unpleasant, report the user from the conversation or from their profile. We may then hide their listings or ban their account.
8. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or applicable law, or if your continued use creates a material risk for other users. You may also stop using the Service and delete your account at any time.
Sections that by their nature should survive termination — including 5 (no transaction guarantee), 9 (intellectual property), 10-12 (warranty disclaimers, liability, and indemnity), and 14 (governing law) — will remain in effect after your account ends.
9. Intellectual property
PuckYard, including its design, code, branding, and all proprietary text, is owned by Explicants and protected by Danish and EU intellectual property law. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.
You retain ownership of the content you post (listing text, photos, messages). By posting, you grant Explicants a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and distribute that content as needed to operate and promote the Service. The licence ends when you delete the content or your account, except where retention is required to comply with law, resolve disputes, or enforce these Terms.
10. Disclaimer of warranties
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or completely secure.
We make no warranty about any item, listing, user, transaction, or message on the Service. You use the Service at your own risk.
11. Limitation of liability
To the maximum extent permitted by Danish law, Explicants and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, data, goodwill, or other intangible loss, arising from your use of the Service or any transaction between users.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under mandatory consumer law that applies to you.
12. Indemnification
You agree to indemnify and hold Explicants harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any third-party right.
13. Changes to these Terms
We may update these Terms from time to time — for example, to reflect changes to the Service or legal requirements. When we do, we will post the updated version here with a new "Last updated" date and, for material changes, notify active accounts by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
14. Governing law and disputes
These Terms are governed by the laws of Denmark, without regard to conflict-of-laws rules. Any dispute arising under these Terms or relating to the Service will be brought exclusively in the courts of Denmark, except where mandatory consumer protection law allows you to bring the claim in your country of residence.
Consumers resident in the EU may also be able to bring a dispute before an approved alternative dispute-resolution body in their own country of residence. In Denmark, where Explicants is established, information is available from Nævnenes Hus at naevneneshus.dk. (The European Commission's online dispute-resolution platform closed in July 2025.)
